Welcome to Vibe, operated by coupletalk.co. These Terms of Service ("Terms") govern your use of our website, mobile application, and all related services. Please read these Terms carefully before accessing or using Vibe. By accessing or using Vibe, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use our Service.

1. Acceptance of Terms

By creating an account, accessing, or using Vibe in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms apply to all users of Vibe, including without limitation users who are contributors of content, information, and other materials or services on Vibe. If you are accepting these Terms on behalf of a business or other entity, you represent and warrant that you have the authority to bind that entity to these Terms. Your continued use of Vibe following the posting of revised Terms means that you accept and agree to the changes.

2. Description of Service

Vibe is an online platform designed to provide relationship guidance, communication tips, and couple-focused content. Through Vibe, users gain access to articles, videos, interactive tools, and resources intended to improve communication and connection between partners. The Service is provided on an as-is basis and includes a subscription-based model with both free and paid features.

The specific features and functionality of Vibe may include but are not limited to:

Vibe reserves the right to modify, suspend, or discontinue the Service or any feature or portion thereof at any time, with or without notice. We are not liable to you or any third party for any modifications, suspensions, or discontinuances of the Service or any features or portions thereof.

3. User Accounts

3.1 Account Creation

To access certain features of Vibe, you must create an account. When creating an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and password. You are solely responsible for all activity that occurs under your account, whether or not you authorize such activity.

3.2 Account Eligibility

You must be at least eighteen (18) years of age to create an account and use Vibe. By creating an account, you represent and warrant that you meet this age requirement and that you have the legal authority to enter into these Terms. Vibe is not intended for minors, and we do not knowingly collect personal information from anyone under the age of eighteen.

3.3 Account Responsibilities

You agree to use your account only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment of Vibe. Prohibited behavior includes:

We reserve the right to suspend or terminate your account immediately and without notice if we determine that you have violated these Terms or engaged in any prohibited behavior.

4. Payment Terms

4.1 Subscription Pricing

Vibe offers a subscription service at a monthly rate of five dollars ($5.00 USD) per month. This subscription provides access to premium features and content beyond the free tier. Pricing is subject to change at any time, with thirty (30) days' written notice. Your continued use of the paid features following a price increase constitutes acceptance of the new pricing.

4.2 Billing Cycle

Your subscription will be billed on a monthly basis on the anniversary date of your subscription commencement. All fees are exclusive of applicable taxes, which will be charged in addition to the subscription fee where applicable. You are responsible for paying all taxes associated with your subscription in your jurisdiction.

4.3 Payment Method

To use the paid features of Vibe, you must provide a valid payment method accepted by Vibe. You authorize Vibe and its payment processors to charge your payment method for the subscription fee and any applicable taxes on a monthly recurring basis. You agree to keep your payment method information current and accurate.

4.4 Failed Payments

If a payment fails or is declined, Vibe will attempt to process the payment again. If payment ultimately fails, your subscription may be suspended or terminated. We are not responsible for any service interruptions due to payment failures. You remain responsible for all charges incurred up until the time your subscription is terminated.

4.5 Cancellation Policy

You may cancel your subscription to Vibe at any time by accessing your account settings and selecting the cancellation option, or by contacting our support team at the email address provided in Section 10 of these Terms. Your cancellation will become effective at the end of your current billing cycle. You will not be charged for any subsequent billing cycles following your cancellation request.

If you cancel during a billing cycle, you will continue to have access to premium features through the end of that current billing cycle. No refund or credit will be issued for the current billing period if you cancel mid-cycle.

4.6 Refund Policy

Vibe does not offer refunds for subscription fees once payment has been processed. Because our Service is delivered immediately upon purchase and can be accessed instantly, we treat all subscription purchases as final. No refunds will be issued for unused portions of a subscription period.

The only exceptions to this no-refund policy are:

All refund requests must be submitted within thirty (30) days of the transaction in question. Refunds will be processed within fourteen (14) business days and returned to the original payment method used for the transaction.

4.7 Auto-Renewal

Your subscription to Vibe will automatically renew on a monthly basis unless and until you cancel it. By subscribing, you acknowledge and agree to this automatic renewal. You must cancel your subscription prior to the renewal date if you do not wish to be charged for the next billing cycle. We will send you a reminder notification before your renewal date, but it is your responsibility to cancel if you do not wish to continue your subscription.

5. Intellectual Property Rights

5.1 Vibe Content and Materials

All content, materials, features, functionality, design, graphics, text, images, videos, information, software, code, and other elements comprising Vibe (collectively, "Vibe Content") are the exclusive property of coupletalk.co and its licensors. Vibe Content is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted are reserved.

5.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use Vibe Content solely for your personal, non-commercial use. This license does not include the right to:

5.3 User-Generated Content

If Vibe permits you to submit, post, or upload content, including but not limited to comments, messages, forum posts, or other user-generated content ("User Content"), you retain ownership of your User Content. However, by submitting User Content to Vibe, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, distribute, display, and perform your User Content in connection with operating and promoting Vibe.

You represent and warrant that you own or have all necessary rights to User Content you submit and that your User Content does not violate any third-party intellectual property rights, privacy rights, or other rights. You are solely responsible for your User Content, and we do not assume responsibility for it.

5.4 Trademark

Vibe, coupletalk.co, and all related logos, marks, and names are trademarks of coupletalk.co. You may not use these trademarks without prior written permission from coupletalk.co.

6. Limitation of Liability

6.1 Exclusion of Damages

To the fullest extent permitted by applicable law, in no event shall coupletalk.co, its officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of or inability to use Vibe, even if we have been advised of the possibility of such damages.

6.2 Cap on Liability

Except where prohibited by law, the total liability of coupletalk.co arising out of or related to these Terms or your use of Vibe shall not exceed the total amount you have paid for your subscription to Vibe in the twelve (12) months preceding the event giving rise to liability. If you have not paid for a subscription or have only used the free tier of Vibe, our liability to you is limited to one hundred dollars ($100.00 USD).

6.3 Unavailability of Certain Remedies

Some jurisdictions do not permit the exclusion or limitation of liability for certain damages. If you are located in such a jurisdiction, the limitations in this section may not apply to you, but we will apply the limitations to the greatest extent permitted by applicable law.
